Terms of Use – Lister Health

These Terms of Use ("Terms") apply to your use of the Lister app and services (the "App"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About Us

The App is operated by Lister Health Pty Ltd (ABN 75 540 445 705) ("Lister Health", "we", "us", or "our"). The App provides transcription and summarisation services to healthcare practitioners for clinical documentation purposes.

2. Your Responsibilities

By using the App, you confirm that:

• You will use the App only in a lawful and professional manner.
• You will obtain all necessary patient consent before recording consultations and using the App.
• You are responsible for ensuring the accuracy, legality, and appropriateness of any data you upload or submit.

3. Our Services

• We use Google Gemini (in Australian data centres) to transcribe audio recordings and Claude AI (via AWS in Australia) to summarise consultations.
• We aim to maintain a high standard of service but do not guarantee that the App will be uninterrupted or error-free at all times.

4. No Medical Advice

The App does not provide medical advice, diagnosis, or treatment. It is a tool to assist healthcare practitioners with clinical documentation. You remain fully responsible for your clinical decisions and patient care.

5. Data and Privacy

We handle personal information in accordance with our Privacy Policy. You agree that:

• Personal information may be processed by our service providers (Google and AWS) within Australia.
• You will not upload data without appropriate consent, especially sensitive health information.

6. Intellectual Property

We own all intellectual property rights in the App, except for any content you upload. You are granted a limited, non-exclusive licence to use the App for its intended purpose.

7. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential loss, including loss of data, revenue, or profits.
• Nothing in these Terms excludes any consumer guarantees or rights under the Australian Consumer Law that cannot be excluded.

8. Suspension or Termination

We may suspend or terminate your access to the App if you breach these Terms or use the App in a way that may cause harm or legal liability.

9. Changes

We may update these Terms from time to time. The latest version will be posted in the App or on our website, with the effective date noted above.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of [insert your state/territory, e.g., New South Wales].
